Illinois DUI Defense
How I Fight DUI Charges in Illinois
A DUI arrest is serious—but it's not a conviction. The right defense strategy changes everything.
The Reality of DUI Charges
Illinois takes DUI seriously. A first offense is a Class A misdemeanor that can result in up to 364 days (just under one year) in jail, fines up to $2,500, and license suspension. But for most people, the criminal penalties aren't the biggest concern.
It's what comes after: the impact on your career, your professional license, your insurance rates, your ability to drive, your reputation. And in Illinois, there's no expungement for DUI—it stays on your record forever.
That's why you need an attorney who fights—not one who just pleads you out.

Arrest & Booking
After arrest, you're taken to the station, booked, and eventually released (usually on your own recognizance with conditions, since Illinois ended cash bail in 2023). You'll receive paperwork including your court date and notice of license suspension.
License Suspension Notice
If you failed or refused the breath test, you received a notice of statutory summary suspension. This is separate from the criminal case. You have 90 days to request a hearing to challenge it.
Arraignment
Your first court appearance, usually 2-4 weeks after arrest. You'll enter a plea (not guilty) and receive future court dates. Having an attorney at this stage is critical.
Discovery & Investigation
Your attorney obtains all evidence: police reports, breath test records, dashcam/bodycam footage, calibration records. This is where weaknesses in the prosecution's case are found.
Motions & Negotiations
Based on the evidence, your attorney may file motions to suppress evidence or dismiss charges. This is where the fight happens. Much of a case's outcome is shaped at this stage.
Trial or Resolution
Cases either go to trial or are resolved through negotiation. The right outcome depends on what we've uncovered during investigation and how hard we fight.
How I Attack DUI Cases
Every case has potential weaknesses. Here's what I look for:
◆ Challenge the Traffic Stop
Police need reasonable suspicion to pull you over. If the stop wasn't legally justified, everything after it may be suppressed.
◆ Attack Field Sobriety Tests
Field sobriety tests must be administered according to strict protocols. Deviations from these protocols can invalidate the results.
◆ Challenge Breath Tests
Breathalyzers require regular calibration and maintenance. Improper calibration, operator error, or medical conditions can produce inaccurate results.
◆ Attack Blood Tests
Chain of custody, proper storage, correct procedures—blood tests have multiple points where errors can occur.
◆ Rising Blood Alcohol Defense
Your BAC at the time of testing may have been higher than when you were actually driving. Timing matters.
◆ Constitutional Violations
Miranda rights, right to counsel, illegal search—constitutional violations can result in evidence being thrown out.
